Tri-State EMC does not have any opposition to customers wanting to add field drainage within our 40′ easement as long as it doesn’t obstruct any underground facilities or minimum clearances of any overhead facilities. However, Tri State EMC has a responsibility to maintain the 40′ right of way and that will require the use of equipment and vehicles that are in excess of 36,000 lbs. With that said, Tri State EMC will not be responsible for any damages incurred to the field drainage placed within the 40′ right of way.
